 You have different rights and duties if you get sick. For example, your sick leave may have consequences in the form of documentation requirements, sick leave interviews and retention initiatives.

Any certificate you need in connection with sick leave must be paid for in the clinic. If necessary, you will receive a receipt and your employer will be obliged to reimburse your expenses.

The certificates cost 800kr for a sick leave certificate, 800kr  We accept  payment by cash or MobilePay.

What should you do if you get sick?

Illness is considered legal decay from work. If you become ill, you must inform your employer immediately that you are ill. If you do not report illness, your employer is not obliged to pay wages during the absence and may as such consider default as a serious breach of the employment contract and cease employment immediately (expulsion).

If you report from work, your employer may require you to document your sick leave. Your employer may require different types of documentation.

Sick leave certificate (Mulighedserklæring)
If you are ill, your employer has the right to request a declaration of illness. The declaration is used if your employer is unsure what considerations need to be taken into account for your health in order for you to return to work in whole or in part.

Your employer may require the declaration at any time during the course of the illness, whether it is a short, repeated or long-term illness, and regardless of whether the medical course has ended.

The statement of option is divided into two:

  1. The first part of the declaration is completed and signed by you and your employer based on a personal interview. Your employer must call you to the interview with reasonable notice (about 1 week). The purpose of the interview is to clarify what opportunities you have in spite of your illness to solve tasks to a greater or lesser extent.

    Please note that you are not obliged to accept changes in your duties to a further extent than the usual rules on changing the content of the position.

    Under the Health Information Act, your employer is not entitled to know what you diagnosis is. Your employer can only require information about your work restrictions.
  2. The second part of the declaration is subsequently completed by your doctor. Based on the first part of the statement (which you are bringing with you) and a conversation with you, the doctor must decide on the possibilities for you to resume work in whole or in part and whether the above-mentioned agreements are sound. The doctor may also propose adaptation of the work and give an estimate of the duration of the disease. If your doctor does not agree with the measures contained in the first part of the statement, the doctor’s assessment is the decisive one.

    You must submit the completed statement to your employer within a reasonable time (approximately 14 days after the first interview). The option must be paid in the clinic. The employer is obliged to reimburse your expenses in connection with this.

If your doctor considers that you should not participate in a personal interview with your employer, the interview may be held by telephone.

However, there may be cases where you are too ill to even participate in an interview. If your doctor determines that you are too ill to participate in a personal or telephone conversation with your employer, or that such a conversation may worsen your condition, you are not obliged to participate in the conversation.

We recommend that it be written down in the first part of the option statement if you and your employer disagree on what tasks you are able to perform.

Free certificate
There will be cases where it is not appropriate to make a declaration of sick leave. For example, on sick leave on the first day of leave, during a notice period, a dismissal situation, or if you are too ill to participate in an opportunity statement interview with your employer.

Your employer may then instead require you to contact your doctor, who can fill out a free certificate with an estimate of the duration of the disease. It must be a prerequisite here for the employer to make a written reasoned request, including the duration of the previous absence. The certificate of sick leave may only be drawn up during current sickness absence.

The employer is obliged to reimburse your expenses in connection with this.

Duration statement
If you are sick for more than 14 days, your employer may require you to obtain a duration statement from your own doctor or a specialist chosen by you. The purpose of the declaration of duration is to enable the employer to assess the expected total duration of sickness absence. The duration statement should not specify what you are doing. The duration declaration must be paid in the clinic. The employer is obliged to reimburse your expenses in connection with this.

Sickness absence interview
Your employer is obliged to call you for an absence call. The conversation should be about when and how you can return to work. For example, it may be a change in the length of working time or special considerations in the form of changed work tasks, resting opportunities or homework. However, you are not obliged to tolerate changes in your duties to a further extent than the usual rules on changing the status of the position.

The interview must be held within four weeks of the first day of sick leave. It must also be held even if you and your employer already have a date for your return to work. The call must be made with reasonable notice, e.g. by telephone, letter or email.
